Sponsor and Administrator : THE FANTASY Reward Points GIVEAWAY (“GIVEAWAY”). Ruby Seven Studios, Inc. is the sponsor (“Sponsor”). The GIVEAWAY is administered by Ruby Seven Studios, Inc. (“Administrator”).

General: By participating in these giveaways, the participant acknowledges and agrees to these Official Rules. Void where prohibited. The applicable promotion period, including the start and end dates and times for each Promotion, is outlined in the “Schedule” section. The odds of winning a prize depend on the total number of entries earned. Sponsor cannot accurately predict the number of people earning entries nor the number of entries earned (each an “Entrant”). All times in this GIVEAWAY refer to Eastern Time. By participating, Entrants agree to be bound by these Official Rules and by all decisions of the Sponsor, whose decisions are at its sole discretion and are binding and final. Failure to comply with these rules will result in disqualification from this GIVEAWAY. Participation in the Drawing does not constitute participation in any other promotion, contest or Drawing. By participating in the Drawing, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all respects.

Eligibility:

Each giveaway is open only to legal residents of the United States (excluding the state of Washington) who are 18 years of age or older as of the Promotion Start Date specified in the Schedule section for that giveaway. Proof of age and residency must be furnished upon request. Employees, officers, directors, managers and members, along with their respective immediate family members, of Sponsor and Administrator advertising or printing vendor and Fantasy Springs Casino Resort along with Delaware North Companies, Incorporated (“DNC”) its affiliates, and any other entities involved in any manner with the marketing, sponsoring, fulfilling or administration of the GIVEAWAY (collectively, the “GIVEAWAY Entities”), are not eligible to participate or win. The term “immediate family member” includes spouses, parents, step-parents, children, step-children, siblings, step-siblings, grandchildren, step-grandchildren or other family extension, regardless of where they live, and any persons residing in the same residence as the winner at least (3) months per year, whether related or not. Only players with a valid email address linked to their Fantasy Springs account by the end of the GIVEAWAY Period will be eligible to participate.

How to Enter:

NO PURCHASE NECESSARY. A purchase will not increase the odds of winning. To enter the GIVEAWAY, please visit https://fantasyspringsslots.com/and (collectively, the “Website”) and/or download and open the Fantasy Springs Slots app from the Apple App Store or Google Play Store (collectively, the “App”) during the GIVEAWAY Period and receive (1) Entry into the GIVEAWAY for every Daily Bonus and Hourly Bonus collected during the GIVEAWAY Period. Normal Internet access, phone charges and usage charges imposed by your online/ phone service provider will apply.

Administrator reserves the right to reject any Entry that it deems, in its sole discretion; to violate any of these requirements. By submitting an Entry (or accepting any prize), each Entrant understands and agrees that their Entry, including individual name may be posted online and further exploited by Administrator for promotional purposes, without further compensation or review, and will not be returned. Each Entrant represents that the Entry is true and correct. Administrator reserves the right to crop or reformat any Entry in whole or in part, to be viewable online. You may be asked to consent to receive promotional emails or offers. This is optional and does not affect your chances of winning a prize in this GIVEAWAY. You are NOT required to give consent to receive such emails or offers in order to participate in the GIVEAWAY or win any prize. You may opt out of this service at any time by clicking ‘unsubscribe’ within the email. The Website’s database clock will be the official timekeeper for online entries in this Drawing.

Entries that do not conform to or that violate these Official Rules or are submitted in any manner other than stated in these Official Rules will be disqualified. By entering this GIVEAWAY, Entrants agree to these Official Rules and the decisions of the Administrator, which are binding and final in all matters relating to this GIVEAWAY. In the event of a dispute over the identity of an entrant, the Entry will be deemed completed by the authorized account holder of the email address captured at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider, wireless carrier, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Administrator is not responsible for, nor assumes any liability for (i) any incorrect or inaccurate Entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (ii) any unauthorized access to, or theft, destruction or alteration of Entries at any point in the operation of this GIVEAWAY; (iii) any miscommunications related to this GIVEAWAY; or (iv) any incorrect or inaccurate capture of information, or the failure to capture any information. Administrator reserves the right to modify, extend, suspend, or terminate the GIVEAWAY if it determines, in its sole discretion, that the GIVEAWAY is technically impaired or corrupted or that fraud or technical problems, failures, or malfunctions or other causes beyond Administrator’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the GIVEAWAY as contemplated herein and to disqualify any individual who tampers with the Entry process.

Administrator is not responsible for late or invalid Entries, which will be disqualified. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated entries will be accepted. Entrants further agree not to knowingly damage or cause interruption of the GIVEAWAY and/or prevent others from participating in the GIVEAWAY. ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY VIOLATE CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY ENTRANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.

Determination of Winner: At the conclusion of each Giveaway Period, the number of winners specified in the Schedule for the applicable Giveaway will be selected at random from all eligible Entries. The winner will be notified at the email address linked to their Fantasy Casino account within ten (10) days of the close of the GIVEAWAY Period. The Administrator’s decisions are final, binding and conclusive on all matters related to the GIVEAWAY. If a winner is not responsive within seventy-two (72) hours of initial notification or in the event of non-compliance with any of these Official Rules, the prize will be forfeited, and an alternative winner will be chosen.

Prizes: Prizes will be awarded at the conclusion of the GIVEAWAY PERIOD. The prizes to be awarded are listed in the “Schedule” section.. Prize may be voided at Administrator’s discretion if it is left unclaimed from the app within 72 hours of the winner being announced in the game. Transfer of any prize is prohibited unless approved by the Administrator. All taxes and all other expenses, costs or fees associated with the acceptance and/or use of a prize are the sole responsibility of the winner. The winner must present valid government-issued identification and provide taxpayer identification information. Administrators may require additional verification of identity. Administrator reserves the right to substitute a similar prize of equal or greater value at its sole discretion. Winners must have a valid membership with Fantasy Casino to redeem prizes. Winners can enroll into Fantasy Casino at the time of redemption. Reward Point prize must be redeemed at Fantasy Casino Resort within 30 days of the close of the GIVEAWAY. Disclaimer and indemnity:

By submitting an Entry, each Entrant waives, discharges and fully releases the GIVEAWAY Entities, along with such entities’ respective officers, directors, managers, members and employees, (the “Released Parties”) from any and all liability, injury, damage, or loss that may occur, directly or indirectly, in whole or in part, from or in connection with participation in the GIVEAWAY or from the receipt or use of any prize or from any activity related to the receipt or use of any prize. The Released Parties are not responsible for (a) any inaccurate Entry information, or for any faulty electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of Entries at any point in the operation of this GIVEAWAY or for any miscommunications or for the inaccurate capture of information, or the failure to capture any information; (c) any technical failures or malfunction of any kind in operation or transmission or communications line failure, regardless of cause, with regard to any equipment, software, systems, networks, lines, satellites, servers, computers or providers; (d) inaccessibility of the Internet or any website of any kind, including any failure of any electronic Entry to be received on account of technical problems or traffic congestion; or (e) any injury or damage to any computer, phone, or tablet device which may be related to or resulting from any attempt to participate in the GIVEAWAY or access or download any materials relating to the GIVEAWAY or the Sponsor’s website. Without limiting the generality of the foregoing, none of the Released Parties assumes any responsibility or liability for (a) damages, losses or injury resulting from acceptance or use of the prize and (b) a lost, stolen, late, misdirected, misprinted, damage, or delayed prize notification and/or prize.

EACH ENTRANT AGREES TO RELEASE, DEFEND, INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY AND ALL LIABILITY FOR CLAIMS, INJURIES, CAUSES OF ACTION, LOSSES, COSTS (INCLUDING REASONABLE ATTORNEY’S FEES) OR DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, WRONGFUL DEATH, PERSONAL INJURY , OR INFRINGEMENT, ARISING OUT OF OR RELATED, IN WHOLE OR IN PART, TO (1) PARTICIPATION IN THE GIVEAWAY OR ANY GIVEAWAY-RELATED ACTIVITY, (2) FROM ITS BREACH OF THE REPRESENTATIONS AND WARRANTIES IN THESE RULES, OR (3) FROM ENTRANT’S POSSESSION, ACCEPTANCE, RECEIPT OR USE/MISUSE OF THE PRIZE, IN EACH INSTANCE WHETHER UNDER CONTRACT, TORT OR ANY OTHER LEGAL THEORY, AND, FURTHER EACH ENTRANT AGREES TO INDEMNIFY THE RELEASED PARTIES AGAINST ANY LIABILITY OR EXPENSE (INCLUDING REASONABLE ATTORNEY’S FEES) ARISING IN CONNECTION WITH THE FOREGOING.Released Parties are not responsible for any inability of any winner to accept or use the prize (or any portion thereof) for any reason.

Internet: If for any reason, the GIVEAWAY is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, and unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Administrator which corrupt or affect the administration, security, fairness, integrity of the game or GIVEAWAY, the Administrator reserves the right in its sole discretion to disqualify any individual it believes has tampered with the GIVEAWAY, undermined the integrity of the GIVEAWAY, and/or cancel, terminate, modify or suspend the GIVEAWAY. The Administrator, DNCB and their respective parent companies, subsidiaries, and affiliates, and the officers, directors, agents and employees of any of the foregoing (i) assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alternation of, Entries, (ii) are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or provider, computer equipment, software, failure of any email to be received by the Administrator on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to the participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this GIVEAWAY.

Disputes/Choice of Law: Except where prohibited, each Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this GIVEAWAY or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Erie County, New York, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, “Special Damages”), and (4) Entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. New York law, without reference to New York’s’ choice of law rules, governs the GIVEAWAY and all aspects related thereto.

Privacy: The information Entrants provide to Administrator will be maintained and used in accordance with Administrator’s Privacy Policy and these Rules located at https://www.fantasyspringsslots.com/privacy-policy/

Publicity: By submitting an Entry or accepting a prize, where permitted by law, each Entrant grants to Administrator (and agrees to confirm that grant in writing) and those acting pursuant to the authority of Administrator the irrevocable right without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter developed, including, but not limited to, the World Wide Web and any social media platform, in perpetuity and throughout the universe, including, without limitation, the Entry and winner’s name, voice, likeness, image or statements about the GIVEAWAY, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation. Administrator may modify, edit or otherwise alter the foregoing in its sole discretion.

Winners List: Winners Selection when complete will be announced in the app. All trademarks, logos, images and brands appearing on the GIVEAWAY website or any other materials relating to the GIVEAWAY are registered and unregistered trademarks of the GIVEAWAY Entities, their subsidiaries and affiliates or their respective owners. FULL TANK FORTUNE GIVEAWAY – ADDITIONAL OFFICIAL RULES

These additional rules apply specifically to the Full Tank Fortune Giveaway. The general Official Rules will also apply unless these additional rules change or add to them. If there is any conflict between the general Official Rules and these additional rules, these Full Tank Fortune Giveaway rules will take priority.

Eligibility:

The Full Tank Fortune Giveaway (“Promotion”) is open to legal residents of the United States (excluding Washington) who are 18 years of age or older and have a registered account with the relevant game. A registered account requires an entrant to have completed a sign in process via an approved platform (such as your phone, Apple, Google or Facebook) which involves the provision of your valid name and contact details. Proof of age and identity must be furnished upon request. Employees, contractors, directors and officers of Ruby Seven Studios, Inc. (“Sponsor”) and each of their parents, affiliates, subsidiaries, distributors, sales representatives, retailers, and advertising, promotion and judging agencies and all other service agencies involved with the Promotion, and members of the immediate family (spouse, parent, child, sibling and their respective spouse) and household of each such employee are not eligible to participate. Self-excluded guests or guests banned from locations owned or operated by Sponsor or an affiliated entity are not eligible to participate. The Full Tank Fortune Giveaway program is free to join.

HOW TO ENTER:

During the Entry Period, you can enter the Promotion in as follows:

a) Fantasy Springs Slots play: eligible entrants who login to Fantasy Springs Slots during the Entry Period will receive entries in the Promotion according to the table below based on play in the Fantasy Springs Slots website and/or mobile app. Plays do not require purchase and can be made utilizing free currency. Your free currency will be replenished at set intervals and you are required to manually redeem the free currency when it becomes available.

b) Mail Entry: You may also at any time enter the Promotion via mail. Send a letter to Ruby Seven Studios, Inc. at 250 Delaware Avenue, Buffalo, NY 14202. The letter should include the Promotion name “Full Tank Fortune Giveaway” and also must include your valid email address, your name, address, city, state, and ZIP code. Mail entries must be postmarked and mailed during the Entry Period to be eligible for the drawing.

Entries that fail to comply with these Official Rules will NOT be honored. Entrants may only enter using a single Fantasy Springs Slots account for Fantasy Springs Slots play. Entrants may not enter multiple times with multiple Fantasy Springs Slots accounts. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different accounts, identities, registrations, logins, or any other methods may void that entrant’s entries and that entrant may be disqualified (and forfeits all prizes won), in Sponsor’s sole discretion. In addition, entrants may not use automated or scripted programs or means to enter either through Fantasy Springs Slots.

In the event of a dispute as to any entry, the “authorized account holder” of the Fantasy Springs Slots accounts used to enter will be deemed to be the entrant. “Authorized account holder” is defined as the natural person who is assigned an email address by the organization that is responsible for assigning email addresses or the domain associated with the submitted entry.
A potential winner may be required to show proof of being the authorized account holder associated with the entry.

Entries received after the conclusion of the Entry Period will not be valid for any prizes or in the case of mail in entries any entry received after the conclusion of the Entry Period must be post marked before the conclusion of the Entry Period. Proof of submission does not constitute proof of delivery. Entries will not be returned and will become the property of Sponsor for promotional and other use, and by entering entrants agree to assign any and all rights in and to the entries, and copyrights thereof, to Sponsor.

DRAWINGS/ODDS : On November 1, 2026 (“Drawing Date”), a random drawing will take place to select 5 prize winners among all eligible entries received during the Entry Period. Winners will be notified within seven (7) calendar days of the Drawing Date in accordance with section 9 below. Entries are cumulative throughout the Entry Period. Odds of winning depend upon the number of eligible entries received during the Entry Period and the number of prizes for each prize category, and the winner of each prize will be selected by random draw from all eligible entries. There is no maximum number of total entries to the Promotion, thus the odds of winning will vary based on the number of entries. A winner need not be present to win. Sponsor’s decisions regarding awarding prizes in accordance with these Official Rules are final.

CONDITIONS OF ENTRY: By entering, entrants: (a) agree that they have read and agree to abide by these Official Rules and all decisions of the Sponsor and its subsidiaries, affiliates, employees and agents, which are final, binding and non-negotiable in all respects; and (b) represent and warrant that they are in compliance with these Official Rules, including all eligibility requirements and that they are not prohibited from participating in the Promotion.

OTHER PROVISIONS:

The Sponsor is not responsible for:

lost, late, incomplete, inaccurate, illegible, misdirected, damaged, incorrect, invalid entries, computer errors or malfunctions; or
incorrect or inaccurate transcription of entry information, failures or delays in computer transmissions, or network connections, human, printing or other errors, technical malfunctions, or any other errors or malfunctions.

Sponsor reserves the right to cancel, extend, suspend and/or modify the Promotion, or any part of it, if any fraud, bugs, viruses, technical failures, or any other factors beyond Sponsor’s reasonable control impairs the administration, integrity, security, fairness or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor will randomly award the prizes from among eligible entries received prior to cancellation. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions, the website, or network connections that are human or technical in nature.

Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process the Fantasy Springs Slots game, the Promotion website, or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Persons submitting entries under false pretenses will be disqualified. Sponsor has no obligation to notify a participant of his/her disqualification. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of the Official Rules or any provision of these Official Rules.

Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

PRIZES:

There will be five (5) winners. Each winner will receive one (1) Shell Gas Card valued at $100. Total Approximate Retail Value (“ARV”) of all prizes in the Promotion: $500.

Prizes will be awarded provided that eligible entries have been received to conduct the drawing. Prizes are non-transferable, and no cash equivalent or substitutions are allowed except at the sole discretion of the Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute the prize with another prize of equal or greater value or a cash payment equal to the value of the prize. Only one (1) prize per person, family/household. All costs and expenses associated with the prizes not specified in these Official Rules, if any, are the sole responsibility of the prize winner(s). Other restrictions may apply. Sponsor is not responsible for any delay or cancellation of prize fulfillment due to unforeseen circumstances, or those outside of Sponsor’s control.

Winners acknowledge that the Released Parties (as defined below) have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefore, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee.

Unclaimed prizes will not be awarded to the party failing to claim them, and if by reason of an error, more prizes are claimed than the number set forth in these Official Rules, all persons making valid claims will be included in a random drawing to award the advertised number of prizes in the prize category in question. No more than the advertised number of prizes will be awarded.

TAXES: All federal, state and local taxes, and other government imposed fees on a prize won and other expenses related to accepting the prize are the sole responsibility of the winner. By accepting a prize, each winner agrees to self-report the winner’s prize earnings to the Internal Revenue Service, as required by law. If a prize has a value of $600 or more, Sponsor will issue the winner a Form 1099 required by the Internal Revenue Code.

WINNER NOTIFICATION : All potential winners are subject to verification, including verification of age and residency. Potential winners will be notified via the email linked to their Fantasy Springs Slots game account, or address used with a mail entry within seven (7) working days after the Drawing Date. Potential winners must respond to the winner notification within three (3) days of attempted notification. Potential winners (who timely respond to the winner notification) may also be required to complete and return a notarized Declaration of Eligibility and Release within seven (7) days of the date the Release was sent. A potential winner that is a resident of Canada will be required to answer a time-limited mathematical skill-testing question to be entitled to the prize. Failure of a potential winner to claim prize or contact the Sponsor within the above stated deadline, return any applicable winner documents within the applicable deadline, failure to complete the skill-testing question or the return of any prize notification as undeliverable may result in the disqualification of the potential winner and the selection of an alternate winner from remaining eligible entries through a separate random draw. If a potential winner cannot be reached or does not respond within the specified time frame, is found to be ineligible or declines to accept the prize (or any portion thereof), the potential winner may be disqualified in the Sponsor’s sole discretion, and in such case the Sponsor may, in its sole discretion, select an alternate potential winner from remaining eligible entries through a separate random draw. Sponsor is not responsible for any change of email address, mailing address, and/or telephone number of entrants.

RELEASES:

As a condition of entering, entrants agree (and agree to confirm in writing): (a) to release Sponsor, its affiliates, subsidiaries, retailers, agents, franchisees and advertising and promotional agencies, and the administrator of the Promotion, and each of their officers, directors, shareholders, members, employees, representatives and agents (“Released Parties”), from and against any and all liability, loss, claim or damage incurred with respect to or arising from participation in the Promotion and/or the awarding, receipt, possession, and/or use or misuse of any prize or any item redeemed therewith or any travel or other activity related thereto; (b) that under no circumstances will any entrant be permitted to obtain awards for, and entrant hereby knowingly and expressly waives all rights to claim punitive, incidental, consequential, or any other indirect damages or attorneys’ fees and court costs, and/or any rights to have damages multiplied or otherwise increased; and (c) all causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action.
By accepting a prize, entrants grant permission to the Released Parties and their designees to use their name, address (city, state/province, country), any photos, videos, descriptions of their person, likeness, statements, voice, biographical information and entry, and, without limitation, any notes, photographs, film, video or audio tape that may be taken of an entrant or of such materials (collectively, the “Content”), and to reproduce, copy, modify, create derivative works of, display, perform, distribute, transmit or broadcast, publicly or otherwise, or otherwise use and permit to be used the Content or any part thereof, in any media now known or hereafter developed, in connection with the advertising and promotion of the Promotion and the Sponsor’s services, without further compensation or notice or right of approval, except where prohibited by law.

FORCE MAJEURE: Without limitation to any other rights set forth herein, the Released Parties are not responsible if the Promotion must be postponed or cancelled or if any prize cannot be provided due to delays, or interruptions due to Acts of God, Acts of War, natural disasters, weather, epidemic, pandemic, or terrorism. Sponsor hereby retains the right (in its absolute discretion) to suspend, modify and/or terminate the Promotion in the event that its completion is prevented or interrupted because of force majeure events, including any strike, fire, war, terrorist, or governmental action, epidemic, pandemic or any disruptive event beyond our control. If the Promotion is suspended as set forth herein, the Promotion shall be deemed extended by a period equivalent to the periods of suspension, unless otherwise announced by Sponsor, in its sole discretion. Notwithstanding the foregoing, no termination hereunder shall affect Sponsor’s rights hereunder or any of its rights in and to the Promotion, which shall remain in full force and effect.

GOVERNING LAW AND JURISDICTION: This Sweepstakes and its Official Rules, excluding any and all disputes, are subject to all applicable United States federal, state, and local laws and regulations. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of New York, United States., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Section 13 of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in court of competent jurisdiction in Erie County, New York.

DISPUTES: You agree that any and all disputes, claims and causes of action relating to the Promotion, these Official Rules and/or the award, receipt, possession, and/or use or misuse of any prize or any item redeemed therewith or any travel or other activity related thereto shall be resolved individually, without resort to any form of class action, exclusively by confidential arbitration in Buffalo, New York, before a single arbitrator pursuant to the then-current Consumer Arbitration rules of the American Arbitration Association. PLEASE NOTE: YOU HEREBY EXPRESSLY ACKNOWLEDGE AND AGREE TO WAIVE YOUR RIGHT TO FILE SUIT IN A COURT OF LAW (INCLUDING ANY CLASS ACTION SUIT) TO ENFORCE YOUR RIGHTS UNDER THIS PROMOTION, THESE OFFICIAL RULES AND/OR THE AWARD, RECEIPT, POSSESSION AND/OR USE OR MISUSE OF ANY PRIZE OR ANY ITEM RELATED THEREWITH OR ANY TRAVEL OR OTHER ACTIVITY RELATED THERETO. Any award rendered shall be final and conclusive upon the parties and a judgment thereon may be entered in the highest court of any forum, state or federal, having jurisdiction. The parties to the arbitration will share equally the administrative costs of such arbitration proceedings. You agree to commence any arbitration proceeding pursuant to this Section 13 within one (1) year after the claim arises. You agree that a proceeding commenced after this date is barred.

Canadian residents participating in this Promotion consent to the transfer, storage, and processing of their Personal Information in the United States, and agree and acknowledge that privacy laws in the United States may differ from those in your Canadian jurisdiction of residence, and your Personal Information may be subject to access by U.S. courts, law enforcement, and national security authorities in accordance with applicable legal requirements.

GENERAL: By participating, entrants agree to waive any right to claim ambiguity in the Promotion or these Official Rules and to waive the application of any legal rule of construction that would require ambiguities to be interpreted against the drafting party. The invalidity or enforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.
